• Protected Health Information (PHI): Because MARC provides mental health and behavioral support services, we may collect PHI. PHI includes information relating to your past, present, or future physical or mental health condition, the provision of health care to you, or payment for that care.
• Donor Information: Information about your donations, including the intended purpose and amount of your gift.

2. How We Use Your Information

We limit the use of your information to the minimum necessary to accomplish the intended purpose. We use your data to:

• Provide support services, including Treatment, Payment, and Health Care Operations.
• Process donation transactions, honor your generosity, and communicate with you about MARC's happenings and fundraising efforts.
• Comply with legal obligations and support company operations such as quality control.

3. How We Share Your Information

We will not sell, rent, or lease your personal or donor information to other organizations. We may share your information only under the following circumstances:

• Business Associates: We may share PHI with third-party persons or entities who assist us in our operations (e.g., billing, data analysis, management), provided they sign a Business Associate Agreement obligating them to safeguard your data.
• Required by Law / Emergencies: We may disclose your information without your authorization for public health activities, judicial proceedings, law enforcement purposes, or to avert a serious and imminent threat to the health or safety of a person or the public.
• With Your Authorization: Any other use or disclosure of PHI, including the use of psychotherapy notes or sharing data for marketing purposes, requires your express, written Authorization.

4. Your Privacy Rights

Under HIPAA and other privacy laws, you have the following rights regarding your PHI and personal data:

• Right to Access: You have the right to inspect and obtain a copy of your PHI, including receiving it in an electronic format if readily producible.
• Right to Amend: You may request that we amend your PHI if you believe it is inaccurate or incomplete.
• Right to Restrict Use: You can ask us to restrict certain uses or disclosures of your PHI. While we are not always required to agree, we must comply if you pay out-of-pocket in full for a service and request we not share that info with a health plan.
• Right to Confidential Communications: You may request to receive communications from us in a confidential manner, such as at an alternative address or phone number.
• Right to an Accounting of Disclosures: You have the right to receive a list of certain disclosures we have made of your PHI for up to six years prior to your request.
• Right to Opt-Out: You may voluntarily remove your name from our internal marketing and communication lists, and we will provide a clear, low-cost opportunity to opt out of any future fundraising communications. Donors also have the right to request that their names and gift amounts remain anonymous.
• Right to Notice of Breach: You have the right to be notified if there is a breach of your unsecured PHI.

5. How We Protect Your Data

We implement Administrative, Physical, and Technical safeguards to protect your electronic and physical data from unauthorized access, alteration, or destruction. This includes restricting access to authorized personnel, utilizing encryption where appropriate, destroying data when it is no longer needed, and conducting ongoing HIPAA training for our workforce.

6. Complaints

If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer or the Secretary of the U.S. Department of Health and Human Services. We will not threaten, intimidate, or retaliate against you for filing a complaint.
